Client Alert: Court Filing Clarifies Government’s Interpretation of “Federal Public Benefit”

A federal court filing this week shed some light on recent revisions to the Government’s interpretation of “Federal public benefit” in Title IV of PRWORA, 8 U.S.C. § 1611.

On Thursday, July 24, 2025, the Trump Administration filed its response in opposition to Plaintiffs’ Motion for a Temporary Restraining Order (TRO) in Washington State Association of Head Start and Early Childhood Assistance and Education Program, et al., vs. Robert F. Kennedy, Jr., et al., Case No. 2:25-cv-00781-RSM (W.D.W.A.).

In its response, the Government acknowledged two key points pertaining to (i) immigration status verification and (ii) eligibility criteria.  While the Government’s position on these issues could change down the road, these representations were made in a federal court filing and therefore represent an accurate view of the Government’s current thinking.

First, the Government confirmed that Title IV of PRWORA, 8 U.S.C. § 1611, does not require non-profit (charitable) organizations to verify immigration status, citing 8 U.S.C. § 1642(d).  This means, for example, that non-profit Head Start agencies would not have to verify the immigration status of the children enrolled in their programs.

Second, the Government stated that “Once a child is enrolled [in Head Start], the Head Start Act provides for continued eligibility for the duration of the program,” citing the Head Start Act (42 U.S.C. § 9840(a)(1)(B)(v)) – which states that “a child who has been determined to meet the eligibility criteria . . . and who is participating in a Head Start program in a program year shall be considered to continue to meet the eligibility criteria through the end of the succeeding program year.”

Feldesman LLP will continue to monitor ongoing litigation challenging the Government’s recent changes in interpretation to “federal public benefit.”
