Feldesman Partner Steve Kuperberg and Senior Counsel Jesi J. Carlson were quoted in the July 9, 2026, edition of 340B Report discussing the Trump Administration’s proposed changes to federal grant regulations, which could have significant implications for federally funded health care providers, including many 340B covered entities.

In the article, “Trump Admin Proposal Could Burden 340B Grantees, Providers Say,” Mr. Kuperberg explained that the proposed rule would apply to federal grant recipients, including Ryan White clinics, federally qualified health centers (FQHCs), Indian Health Service facilities, and other 340B grantees. He also discussed the proposal’s potential operational impact, noting that workforce-related requirements could ultimately affect the delivery of patient care.

Ms. Carlson addressed the proposal’s employment-related provisions, including a requirement that federal grant recipients and subrecipients use the U.S. Department of Homeland Security’s E-Verify system and report employees who are determined not to be authorized to work in the United States. She noted that while some organizations already use E-Verify, the proposal would impose new compliance obligations on many grant recipients and raise questions about how the reported information would ultimately be used.

The proposed rule, issued by the Office of Management and Budget (OMB), is intended to revise the federal government’s Uniform Guidance governing federal financial assistance. The public comment period closed on July 13, 2026, and OMB is expected to issue a final rule later this year.
